Roberto M. Garcia is a duly appointed Union Representative and represents employees during the course of any administrative or criminal investigation. Mr. Garcia is also the Local 3307 PORAC LDF Panel Attorney. Mr. Garcia has represented our members in numerous incidents. As General Counsel, he provides guidance to the Local 3307 Executive Board on matters affecting the membership. Mr. Garcia has also represented employees in other Border Patrol Sectors as a PORAC LDF Attorney.

Mr. Garcia graduated from Texas A&I University in Kingsville, Texas with a Bachelor of Arts Degree in Government in 1972. In 1976, he received his Juris Doctor Degree from Texas Southern University, Thurgood Marshal School of Law in Houston, Texas. While in Law School, Mr. Garcia received the American Jurisprudence Award for Excellence in the study of contracts. Throughout his professional career, Mr. Garcia has always maintained a general civil practice specializing in public service employee representation including municipal, county, state and federal law enforcement personnel, and municipal firefighter employees. His law practice includes extensive involvement in providing legal representation to employees in administrative and internal affairs investigations, employee disciplinary appeals to third party hearing examiners, grievances, and collective bargaining contracts. Mr. Garcia has also provided legal representation before the Equal Employment Opportunity Commission and the Merit Systems Protection Board. He is licensed to practice in all State Courts and before the United States District Court for the Southern District of Texas, as well as the U.S. 5th Circuit Court of Appeals. While attending College, Mr. Garcia served in the United States Army Reserve and was honorably discharged in 1976 with the rank of Sp. 4.

Mr. Garcia has been engaged in private practice as an attorney since 1976. Mr. Garcia also served as General Counsel to the South Texas Organization of Police (STOP), and the International Union of Police Associations (IUPA), Local 51. He was also a Regional Attorney for the Texas Municipal Police Association. He has served as contractual counsel to the McAllen Firefighters Association, the Texas Association of Firefighters, and the Texas Federation of Teachers. He is currently a CLEAT Attorney for South Texas. Mr. Garcia is an American Arbitration Association certified Mediator and a certified Labor Arbitrator with the Federal Mediation and Conciliation Service. He conducts mediations and arbitrations in the personal injury and employment areas, as well as in general civil matters such as construction, real estate, commercial and business areas. Mr. Garcia has also been trained and certified by the Texas Education Agency as a certified Hearings Examiner, and provides over hearings involving school districts and school teachers.

He is a member of the State Bar of Texas, the Hidalgo County Bar Association, the Texas Association of Mediators, the National Employment Lawyers Association, the Texas Employment Lawyers Association and the ADR, Business, Labor and Employment and Litigation Law Sections of the State Bar of Texas. Mr. Garcia has also served as an elected Trustee of the McAllen Independent School District and was a participant and member of the Board of Directors of Leadership McAllen. He is also an approved Attorney for the AFGE Union Plus Legal Services Plan.
